Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of the Invitio digital invitation platform (Invitio Events brand), the website https://invitio.events, related applications, and related services, including Planner, Pics, messaging, and optional connectors such as ChatGPT / MCP (together, the "Platform"). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Acceptance and definitions

By creating an account, purchasing a plan, connecting a third-party service, or using any Platform feature, you confirm that you have read and agree to these Terms and our Privacy Policy. "User," "you," or "your" means the person or entity using the Platform. "Invitio," "we," or "our" means the operator of Invitio Events.

2. Eligibility and accounts

You must have legal capacity to contract under applicable Mexican law. If you use the Platform on behalf of an organization, you represent that you have authority to bind it to these Terms.

  • You must provide truthful, complete, and up-to-date registration information
  • You are responsible for keeping your credentials confidential and for all activity under your account
  • Notify us promptly if you suspect unauthorized access
  • Invitio may suspend or terminate accounts that violate these Terms or present fraud, abuse, or security risks

3. License and acceptable use

Invitio grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform according to your plan or subscription and these Terms. This includes personal use and professional or organizational use (for example, Planner), according to the features you purchase.

You agree not to:

  • Use the Platform unlawfully, fraudulently, or in a way that infringes third-party rights
  • Attempt unauthorized access to systems, accounts, or others’ data
  • Interfere with the security, availability, or integrity of the Platform
  • Reverse engineer, copy, or resell the Platform except with express authorization
  • Send spam, phishing, or unsolicited or deceptive communications through the Platform
  • Upload malware or unlawful, defamatory, obscene content, or content that violates intellectual property or image rights
  • Use bots or abusive automation outside official authorized integrations (including MCP)

4. User content and invitations

You retain rights in the content you upload or create (text, images, videos, guest lists, invitation designs, messages, and related data) ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display that content only as needed to operate and improve the Platform and provide the services you request.

You are solely responsible for: (i) obtaining required consents from guests and third parties; (ii) the accuracy of guest and event data; (iii) how you share invitation links (public or shareable links may be accessible to anyone with the URL); and (iv) complying with applicable laws when processing third-party data.

5. Collaborators and roles

You may invite collaborators to events with limited roles (for example, admin, editor, or reader). You are responsible for the actions of people you grant access to. Collaborators must use the Platform under these Terms and the permissions you assign.

6. Plans, payments, and refunds

Some features require payment (for example, premium plans, Pics, bundles, or Planner subscriptions). Prices, applicable taxes, and conditions are shown at checkout. Payments are processed by external providers (such as Stripe, PayPal, Mercado Pago, or app stores).

Except where required by law, purchases are also governed by our Refund Policy published on the Platform. Invitio may change prices or plans with reasonable notice; changes will not retroactively affect already-paid periods unless permitted by law or expressly stated.

7. WhatsApp messaging and communication channels

The Platform may allow sending messages (including automated messages or templates) via WhatsApp or other channels through integrations with Meta, Twilio, or other providers. You are solely responsible for message content, recipient numbers, and for having the legal bases and consents needed to contact those people.

Invitio does not control and is not responsible for: spam reports or blocks by carriers or Meta/WhatsApp; third-party policies or outages; or misuse of numbers or templates by the User. The User assumes responsibility for claims arising from messages sent through the Platform.

8. ChatGPT / MCP connector and third-party services

You may optionally connect your Invitio account to ChatGPT or other MCP clients via OAuth. By doing so, you authorize those tools to read and, according to permissions and role, update your event and guest data as described in the connector’s published capabilities and our Privacy Policy.

You are responsible for: (i) reviewing and approving actions you request from the AI client; (ii) not sharing credentials insecurely; and (iii) disconnecting the connector when you no longer want that access. Invitio does not control the models, retention, or policies of OpenAI or other AI providers, and does not guarantee the accuracy of responses generated by those clients.

The Platform may also integrate third-party services (payments, maps, analytics, email, storage, wallets, etc.). Use of those services may be subject to the third party’s own terms.

9. Invitio intellectual property

The Platform, its software, trademarks, templates, designs, logos, text, interfaces, and other Invitio materials are owned by Invitio or its licensors. These Terms do not transfer any ownership of the Platform to you. You may not use Invitio marks or materials without prior written permission, except as needed to use the service.

10. Privacy

Personal data processing is described in our Privacy Policy (https://invitio.events and localized /privacy-policy routes). By using the Platform, you accept those practices to the extent permitted by law. If you process guest or other third-party data through the Platform, you act as an independent controller for that data and must comply with applicable law.

11. Availability, support, and service changes

We strive to keep the Platform available and secure, but we do not guarantee uninterrupted availability or a complete absence of errors. We may modify, suspend, or discontinue features with reasonable notice when feasible, especially for maintenance, security, or legal requirements. Support is provided through published channels (for example, support email or WhatsApp).

12. Disclaimer of warranties

To the maximum extent permitted by law, the Platform is provided "as is" and "as available," without express or implied warranties of merchantability, fitness for a particular purpose, non-infringement, or specific results (including event success, third-party message delivery, or accuracy of AI assistants).

13. Limitation of liability

To the maximum extent permitted by law, Invitio and its directors, employees, partners, and agents will not be liable for indirect, incidental, special, consequential, lost profits, data loss, or punitive damages arising from use of or inability to use the Platform, even if advised of the possibility.

Without prejudice to the foregoing, and except for willful misconduct or inexcusable negligence where liability cannot be limited by law, Invitio’s aggregate liability to you for claims related to these Terms or the Platform will not exceed the amounts you paid Invitio for the specific service giving rise to the claim during the twelve (12) months preceding the event, or, if there was no payment, the equivalent of one Unidad de Medida y Actualización (UMA) then in force in Mexico.

14. Indemnification

You agree to defend, indemnify, and hold harmless Invitio and its directors, employees, partners, and agents from claims, damages, losses, liabilities, and reasonable expenses (including attorneys’ fees) arising from: your use of the Platform; your User Content; messages you send; your breach of these Terms; or your violation of third-party rights or applicable law.

15. Suspension and termination

You may stop using the Platform at any time and, when available, request account deletion. Invitio may suspend or terminate access if you breach these Terms, if required by law, or to protect the Platform or other users. Upon termination, licenses granted to you end, without prejudice to provisions that by their nature should survive (intellectual property, limitation of liability, indemnification, governing law, among others).

16. Changes to the Terms

We may update these Terms periodically. The “Last Updated” date indicates the current version. Continued use of the Platform after publication constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Platform.

17. Governing law and jurisdiction

These Terms are governed by the laws of Mexico. Any dispute will be submitted to the exclusive jurisdiction of the competent courts of Mexico, without prejudice to non-waivable consumer rights you may have under applicable law.
